Texas AG Paxton Launches Second Strike Against Austin ISD Over Boys In Girls’ Restrooms

Texas Attorney General Ken Paxton has sent an additional notice to the Austin Independent School District demanding documentation of policies and enforcement actions regarding the use of female facilities by biological males, citing ongoing concerns over compliance with the Texas Women’s Privacy Act.

Monday’s action follows a March 2026 notice to the district after a citizen complaint alleged that a biological male had been using girls’ restrooms and locker rooms at Austin High School. Austin ISD asserted compliance in its response but did not provide the requested policy documentation, according to the attorney general’s office. A new complaint has now prompted further demands.

In the latest notice, Attorney General Paxton’s office detailed a report that on or about April 2, a male student entered and used a girls’ restroom at the AISD Performing Arts Center. The letter seeks updated policies to confirm consistent enforcement of Senate Bill 8 across the district.

“It is appalling that woke Austin ISD officials won’t do what is required by law to protect girls’ privacy and safety from males invading their spaces,” said Paxton in the April 27 press release. “I will continue to hold Austin ISD accountable and ensure that any violations of the Texas Women’s Privacy Act are fully investigated and prosecuted to the fullest extent.”

Senate Bill 8, known as the Texas Women’s Privacy Act, prohibits political subdivisions, including public schools, from allowing biological males to use women’s restrooms, locker rooms, and similar facilities. The law imposes potential penalties of $5,000 per day for ongoing violations. The March notice served as a statutory prerequisite for possible litigation, giving the district 15 days to address the issues.

This development marks the latest interaction between Paxton’s office and Austin ISD. In September 2025, the district reached a settlement in a separate case involving allegations that it taught critical race theory in violation of state law. Records indicate that litigation cost the district more than $22,000, per KXAN.

Austin ISD has faced multiple inquiries from the attorney general in recent months, including one related to student protests, as previously reported on by The Dallas Express. Regarding the bathroom matter, the district previously stated that it was aware of the concerns and was working to determine the facts. In response to the March notice, it said, “We have received the Attorney General’s notice and will respond accordingly,” reported AustinCurrent.

Paxton’s office launched a tip line to receive reports of potential violations of the Privacy Act. The latest notice reiterates encouragement for Texans to report suspected incidents.
