A U.S. federal judge has ordered former President Donald Trump to file supplemental material before ruling on his motion for a Special Master to oversee the FBI investigation into his possession of allegedly classified information.
U.S. District Judge Aileen Cannon, a Trump appointee, instructed Trump’s legal team to resubmit the motion with additional clarification and evidence by Friday.
The original motion from Trump asked for “Judicial Oversight And Additional Relief,” specifically requesting the appointment of a Special Master.
Additionally, Trump asked for the “further review of seized materials by the Government until a Special Master is appointed.”
The former president also requested that the government provide a “more detailed Receipt for Property” and asked “the Government to return any item seized that was not within the scope of the Search Warrant.”
Judge Cannon, however, suggested that the original motion did not include enough justification to issue a decision on the matter. Specifically, she asked for more information concerning:
“(1) the asserted basis for the exercise of this Court’s jurisdiction, whether legal, equitable/anomalous, or both; (2) the framework applicable to the exercise of such jurisdiction; (3) the precise relief sought, including any request for injunctive relief pending resolution of the Motion; (4) the effect, if any, of the proceeding before Magistrate Judge Bruce E. Reinhart; and (5) the status of Plaintiff’s efforts to perfect service on Defendant.”
Although no formal steps have been taken yet, a spokesman for the Justice Department noted that “the Department is aware of this evening’s motion. The United States will file its response in court.”
Judge Reinhart recently ordered the U.S. Department of Justice to release a redacted version of the underlying affidavit, which was made public on Friday, August 26, as reported by The Dallas Express.
Trump has maintained that the FBI raid was “illegal and unconstitutional.”
He commented further, claiming that his team was “taking all actions necessary to get the documents back … So that I can give them to the National Archives until they are required for the future Donald J. Trump Presidential Library and Museum.”
