Ex-IRS Agent Drops Bombshell Claim: Most Americans Not Legally Required To Pay Income Tax

A former IRS criminal investigator is making explosive claims about the federal income tax system — arguing that most Americans are not legally required to pay it.

Joseph Banister, a former IRS special agent, laid out his argument in a recent interview on the Going Rogue podcast, where he challenged how the government enforces income tax laws.

Banister said he reached his conclusions while working inside the IRS, after closely examining the tax code. He argued that Congress never explicitly made the average American worker liable for federal income tax and claimed the system relies heavily on voluntary compliance.

“If you’re living and working in the United States, you can’t find any law that makes you liable to pay an income tax on … your earnings,” Banister said.

He also argued that taxpayers create their own liability when they file returns, describing the process as entering into an agreement that allows the IRS to assess taxes.

Banister left the agency after raising concerns internally. Federal prosecutors later charged him, but a jury acquitted him of all counts in 2005.

During the interview, Banister accused the IRS of using outdated systems, internal procedures, and aggressive tactics to maintain compliance. He also claimed the agency avoids directly answering key legal questions about tax liability.

The episode taps into growing frustration among Americans over government spending, fraud, and accountability — and raises broader questions about how federal power gets enforced.

Banister’s claims have circulated for decades and remain widely disputed. Federal courts have repeatedly upheld the legality of the income tax system and rejected similar arguments.
