Texas Att. Gen. Ken Paxton has officially filed his 100th lawsuit against the Biden-Harris administration, a milestone he hopes highlights his ongoing fight against federal overreach in America.
“For the past four years, the Biden-Harris Administration routinely violated the Constitution to implement an agenda that harmed our Nation,” Paxton said via a recent press release.
The most recent lawsuit filed this week is aimed at blocking a new rule by the Federal Communications Commission that Paxton claims “arbitrarily limits State’s rights and unlawfully burdens taxpayers.” The rule forces taxpayers to assume the costs for prisoners’ phone calls, which Paxton says violates the Administrative Procedures Act.
Paxton has been challenging Biden’s administration’s policies since its beginning.
His first major legal victory came early in January 2021, when he sued the current President just days after he took office, as previously reported by The Texas Tribune. That first lawsuit contested Biden’s executive order halting deportations in America, a move the Attorney General argued was a direct violation of America’s immigration law.
Since then, Paxton has filed seemingly nonstop lawsuits against Biden on various issues, including immigration, environmental regulations, federal spending, and even censorship.
Notably, Paxton played a pivotal role in challenging Biden’s previous decision to halt the construction of the border wall.
In 2022, Paxton’s legal team successfully argued that Biden’s diversion of funds meant for the wall construction was illegal, prompting a court order to ultimately resume construction. Just recently, Paxton secured a key victory in halting the Biden administration’s attempt to redirect congressionally mandated funds away from border wall construction in the future.
In addition to a multitude of past high-profile cases, Paxton has also led efforts to block Biden’s “parole in place” policy, which would have granted amnesty to millions of undocumented immigrants. That policy, Paxton argued, violated federal law by providing widespread relief without “congressional approval.”
Paxton’s office filed a lawsuit on November 11 against U.S. Attorney General Merrick Garland and the DOJ to stop the destruction of records connected to Special Prosecutor Jack Smith’s investigation into President Donald Trump, an investigation that Paxton called “corrupt.”
On November 8, Paxton submitted a Freedom of Information Act request to the DOJ, seeking access to documents related to Smith’s controversial investigation. This legal action follows concerns that previous special counsels, like Robert Mueller, destroyed records without facing consequences. In a recent public letter, Paxton voiced his hope to prevent a similar outcome in Smith’s probe, which he views as unconstitutional.
According to Paxton, his office has secured favorable rulings in more than 75% of the lawsuits it has filed against the Biden administration.
