Attorney General Ken Paxton announced on Tuesday that an injunction has been granted that prevents federal agents from cutting concertina wire along the border meant to deter unlawful migrants from entering Texas.

An earlier ruling by U.S. District Judge Alia Moses ended an emergency restraining order that prevented federal agents from cutting the wire, but this decision was quickly appealed by Paxton, as previously reported by The Dallas Express.

That appeal was then granted by the Fifth Circuit Court of Appeals, which stated that federal agents would be barred from “damaging Texas’s wire fences while the U.S. Department of Justice prepares a response to Texas’s motion for an injunction pending appeal of the district court’s order.”

The newest injunction, pending appeal from the federal government, from the Fifth Circuit Court of Appeals states federal agents are barred from “damaging, destroying, or otherwise interfering with Texas’s c-wire fence in the vicinity of Eagle Pass, Texas.”

However, the injunction clarifies that agents are permitted “to cut or move the c-wire if necessary to address any medical emergency.”

“I am very pleased the appellate court has forbidden federal agents sent by the Biden administration from destroying our concertina wire fences,” stated the attorney general in a news release sent to The Dallas Express detailing the injunction.

“Given the ongoing disaster at the southern border due to the federal government’s intentional actions, more than ever it is necessary to take every step we can to hold the line. I will continue to fight against the Biden administration’s radical policies and work to make Texas a safer, more secure place to live.”

This ongoing conflict between the Lone Star State and the federal government has escalated in recent months following the initial lawsuit filed by Paxton alleging that “[s]ince September 20, 2023, federal agents have developed and implemented a policy, pattern, or practice of destroying Texas’s concertina wire to encourage and assist thousands of aliens to illegally cross the Rio Grande and enter Texas.”

Gov. Greg Abbott has stated that Texas is currently “at war with the White House, fighting to secure our own border,” as previously reported by The Dallas Express.

However, a statement from the White House, attributed to President Joe Biden, states that the federal government is doing everything possible “to manage the border in a safe, orderly, and humane manner while honoring the promise of America that has led generations of immigrants to become part of our Nation’s fabric.”
