President Donald J. Trump signed an executive order Monday designating illicit fentanyl and its core precursor chemicals as weapons of mass destruction, a move the administration says will escalate the federal response to the nation’s opioid crisis.

Under the order, federal agencies are directed to coordinate enhanced criminal prosecutions, financial penalties, and national security resources to counter fentanyl trafficking and distribution networks.

The executive order directs the Attorney General to immediately pursue investigations and prosecutions in fentanyl trafficking cases, including criminal charges, sentencing enhancements, and sentencing variances.

It also instructs the Secretaries of State and the Treasury to pursue actions against assets and financial institutions involved in or supporting the manufacture, distribution, and sale of illicit fentanyl and its core precursor chemicals.

The order further directs the Secretary of War and the Attorney General to determine whether the Department of War should provide enhanced national security resources to the Department of Justice during emergency situations involving fentanyl designated as a weapon of mass destruction. The Secretary of Homeland Security is also instructed to identify fentanyl smuggling networks using weapons-of-mass-destruction and nonproliferation-related threat intelligence.

In a fact sheet accompanying the announcement, the White House characterized illicit fentanyl as “closer to a chemical weapon than a narcotic,” citing its extreme potency. As little as two milligrams — roughly equivalent to 10 to 15 grains of table salt — can be lethal. The administration also cited fentanyl as a leading cause of death among Americans aged 18 to 45.

Federal officials said cartels and designated foreign terrorist organizations use fentanyl profits to fund assassinations, terrorism, and armed conflicts over trafficking routes. The administration warned of the drug’s potential to be weaponized for concentrated, large-scale attacks by organized adversaries.

The executive action builds on earlier Trump administration measures targeting drug trafficking, including the declaration of a national emergency at the southern border, the designation of multiple cartels as foreign terrorist organizations, and enforcement actions aimed at disrupting international trafficking networks.

The administration said the designation is intended to focus and coordinate the full weight of the federal government against illicit fentanyl while not affecting its legitimate medical use.
