Smiley Allen Martin, the second man arrested in the wake of Sunday’s mass shooting in Sacramento that killed six people, was released from jail about a month before the shooting. He was released amid prosecutors’ arguments that he “clearly has little regard for human life and the law.”
The 27-year-old has a criminal history dating back to 2013 and was the subject of a plea by Sacramento County District Attorney Anne Marie Schubert’s office last year that he not be released from prison early. He was serving a 10-year sentence for domestic violence and assault with great bodily injury incident in 2018.
Danielle Abildgaard, the Deputy District Attorney, argued against his early release from jail in April of 2021. In a letter to the parole board, she wrote that Smiley displayed a pattern of criminal behavior his entire adult life.
Last April, Sacramento County District Attorney Anne Marie Schubert’s office said, “As shown by Inmate Martin’s pattern of conduct, he is an assaultive and non-compliant individual and has absolutely no regard for his victims who are left in the wake of numerous serious offenses.”
Smiley and his brother, 26-year-old Dandrae Martin, were believed to be together during the Sacramento shooting, according to Sacramento Police Department Sgt. Zach Eaton.
On Tuesday, police arrested Smiley at a hospital after being wounded in the shooting. He faces charges of possessing a machine gun and possession of a firearm by a prohibited person. He has been under police surveillance since his arrest. Once he is released from the hospital, he will be booked into the Sacramento County Main Jail, according to the police department.
Dandrae was the first individual detained in relation to the shooting, and he was charged with possession of a firearm by a prohibited person.
Daviyonne Dawson, 31, was also detained on charges of possessing a handgun when forbidden. According to authorities, he was observed carrying a pistol soon after the shooting.
“At this time, Dawson is not charged with crimes directly related to the shootings,” said the Sacramento Police. “Based on the type of firearm recovered, detectives do not believe that this gun was used in the shooting.”
The mass shooting claimed the lives of Johntaya Alexander, 21; Melinda Davis, 57; Yamile Martinez-Andrade, 21; Sergio Harris, 38; Joshua Hoye-Lucchesi, 32; and De’vazia Turner, 29.
