According to a document allegedly leaked from the Department of Homeland Security (DHS), the soon-to-expire CDC Title 42 emergency order is set to be replaced with a plan that avoids removing unlawful migrants.

On April 1, the Biden administration announced its intent to rescind Title 42, which has allowed for the quick expulsion of unlawful migrants since March 2020 due to concern they might be carrying the virus that causes COVID-19.

DHS’s proposal for the policy that will replace Title 42, reportedly sent to senior DHS personnel, was examined by Breitbart Texas.

The “DHS Southwest Border Mass Irregular Migration Contingency Plan,” dated February 17, 2022, states:

“[The DHS] … will take action to humanely prevent and respond to surges in irregular migration across the U.S. Southwest Border Security and Irregular Migration Zone … while ensuring that migrants can apply for any form of relief or protection for which they may be eligible, including asylum, withholding of removal, and protection from removal under the regulations implementing United States obligations under the Convention Against Torture.”

The proposal was allegedly drafted to comply with a previous executive order from President Joe Biden. The order directed officials to create a framework to address the causes of unlawful migration and provide “safe and orderly processing” for unlawful migrants seeking asylum once they entered the United States.

The DHS plan predicts that the removal of Title 42 will cause a border surge and “have a direct impact to short-term holding and processing capacity along the SWB (southwest border).”

As previously reported by The Dallas Express, unlawful migrant apprehensions are already showing signs of an increase.

According to the DHS document, it is alleged that most released unlawful migrants do not show up for future deportation proceedings. In 2021, almost 95,000 unlawful migrants were released without a judicial order, and officials subsequently mailed them charging documentation. However, in November 2021, Homeland Security Secretary Alejandro Mayorkas informed members of Congress that the practice had been terminated.

After examining the plan, Rep. Andy Biggs (R-Ariz.) said in an email to The Epoch Times that Biden and Mayorkas “have eviscerated our nation’s border security and immigration enforcement apparatus through various illegitimate executive orders and memorandums.”

Prior to the release of the document allegedly originating from the DHS, Secretary Mayorkas made claims that the agency fully intended to remove unlawful migrants.

“Once the Title 42 Order is no longer in place, DHS will process individuals encountered at the border pursuant to Title 8, which is the standard procedure we use to place individuals in removal proceedings,” he said. “Nonetheless, we know that smugglers will spread misinformation to take advantage of vulnerable migrants. Let me be clear: those unable to establish a legal basis to remain in the United States will be removed.”

“The Biden-Harris Administration is committed to pursuing every avenue within our authority to secure our borders, enforce our laws, and stay true to our values,” added Mayorkas. “Yet a long-term solution can only come from comprehensive legislation that brings lasting reform to a fundamentally broken system.”
