ICE Dallas arrested Jose Luis Morales Huerta, a twice-deported sexual predator wanted on multiple child sex assault charges, agency missives said.

According to ICE’s “worst of the worst’ website, Morales Huerta, 51, was taken into custody on August 25.

“ICE Dallas arrested Jose Luis Morales Huerta, a 51-year-old sexual predator from Mexico, on Aug. 25. His criminal history includes aggravated sexual assault of a child. He also has an active warrant out of Dallas County, Texas, for three additional sexual assault of a child charges and an active federal warrant for violation of supervised release. He has been removed from the U.S. twice,” the agency website states.

ICE Dallas also posted on August 27 that it had arrested Morales Huerta, “a twice-deported child predator wanted for sexually assaulting a child in Dallas County who has been convicted of aggravated sexual assault of a child, failure to register as a sex offender, illegal reentry, and a weapons offense.”

 

Morales Huerta has a lengthy criminal record, including a federal conviction for illegal reentry after being deported. In a recent Fifth Circuit Court of Appeals opinion, he challenged his 30-month prison sentence, arguing that the statute allowing a longer sentence violated constitutional protections. The court rejected his argument, noting that the issue was foreclosed by the Supreme Court’s 1998 decision in Almendarez-Torres v. United States. The Fifth Circuit also affirmed his three years of supervised release.

“Morales-Huerta has not briefed, and therefore has abandoned, any challenge to his conviction and sentence for failure to register as a sex offender,” the court wrote.

It is unclear if Morales Huerta will face further prosecution or deportation. ICE Dallas did not immediately respond to a request for comment.
