Immigration detainers allow federal officers to take custody of removable aliens in secure jail settings rather than pursuing them “at-large in the community,” according to ICE’s website. The agency website claims this process helps “protect the public from national security, public safety, and border security threats.”
Immigration detainers are requests, not mandates, sent to local law enforcement asking that an individual believed to be removable from the United States be held for up to 48 hours beyond their release time so that federal authorities can assume custody.
ICE generally issues such requests after establishing probable cause that the person is removable and poses a public safety threat, often after convictions for serious crimes, including “sexual assault,” “kidnapping,” and “homicide,” according to the agency’s public guidance.
Three of the five men featured in this month’s Dirty John series, Chairez-Solorzano, Cruz, and Lamamy, were booked with immigration detainers.
Each of the men remains in county custody pending legal proceedings. All defendants are presumed innocent until proven guilty in a court of law.
