A federal judge appointed by former President Joe Biden has sentenced the man who plotted to kill Supreme Court Justice Brett Kavanaugh to eight years in prison, a decision that has drawn criticism from many who argue the punishment is too light.

In response, the Department of Justice has announced that they will appeal the sentence.

“The attempted assassination of Supreme Court Justice Brett Kavanaugh was a disgusting attack against our entire judicial system by a profoundly disturbed individual,” said Attorney General Pamela Bondi. “The Department of Justice will be appealing the woefully insufficient sentence imposed by the district court, which does not reflect the horrific facts of this case.”

U.S. Sen. Ted Cruz also criticized the ruling, calling for the impeachment of District Judge Deborah Boardman and criticizing the sentencing as a blatant miscarriage of justice.

Nicholas Roske, who now identifies as a “transgender woman” named Sophie, was arrested in June 2022 outside Kavanaugh’s Maryland home, as previously reported by DX. Police say Roske carried a Glock pistol, ammunition, a tactical vest, zip ties, a knife, duct tape, and other tools. He reportedly told investigators his goal was to kill Kavanaugh, and possibly Chief Justice John Roberts, to stop the Supreme Court from overturning Roe v. Wade.

Roske’s defense team argued that the sentence reflected Roske’s mental health struggles and lack of a prior criminal record. His attorneys also argued in court that he was in a “psychotic spiral” fueled by online extremism and “post-Roe” anger.

Prosecutors in the case pushed for a 30-year sentence, but Boardman, a 2021 Biden appointee, sentenced Roske to just 97 months—about eight years and one month in total. The ruling set off sparks among some politicians who see it as another example of Democrats being soft on crime.

“This judge has demonstrated she is utterly unfit to be a federal judge,” Cruz said during a taping of his “Verdict” show on Monday. “The House of Representatives should seriously contemplate impeaching this judge.”

Cruz further accused Boardman of allowing left-wing politics to shape her decision and showing leniency because of Roske’s “transgender identity.”

“Nicholas Roske will now pay the price for attempting to assassinate a Supreme Court Justice in a violent plot to alter the court’s composition and its rulings,” said FBI Director Kash Patel.

“Violence against federal judges or other public officials is unacceptable and will be met by the full force of the law. The FBI will work aggressively with our law enforcement partners to detect and stop these schemes and protect our nation,” Patel added.

Boardman did not reply to inquiries for comment from DX as of press time.
