A mother has testified after her daughter’s death in a crane accident.
Kiersten Smith was killed in an accident that injured five others when a construction crane collapsed into her apartment building in June 2019. Reconstruction in this area began in 2021.
Michele Williams, Smith’s mother, then proceeded to sue Greystar, the developer in the area who was responsible for the crane.
Officials for Greystar appeared before a jury in a trial for the woman’s death on April 17. Attorneys questioned the officials to determine whether the company bears any responsibility for her death.
An attorney for Smith’s mother asked questions regarding the company’s safety protocols that were in place at the time of the accident.
Philip Treacy, a project director for Greystar, appeared before the stand on the date of the trial and said the company would not take responsibility for the accident. Treacy said the company would not accept liability due to the crane being owned and operated by Bigge Crane and Rigging.
However, both Greystar and Bigge Crane and Rigging agreed that Robert Hilty, the crane operator, had not followed proper safety protocol before leaving his post as severe weather arrived.
Then, attorney Jason Itkin revealed a contract detailing Bigge Crane and Rigging leased the crane and the operator to Greystar, thus rendering Greystar responsible.
“There was a systemic failure and a reckless disregard for safety,” said Itkin, according to KERA.
Williams appeared before the jury and recounted personal stories of her daughter before her death. The stories detailed a visit from Smith to see the dress Williams had intended to wear to Smith’s wedding.
Cody Peacock, another building resident, also testified of his experience that day. Peacock recounted the moment he heard the impact, as well as his efforts to escape the building.
This trial has yet to conclude. Attorney Chad Ruback, who has no connection to the case, told Fox 4 News that the latest testimony would remain with jurors as they approach a decision.
