Former President Donald Trump has responded after CNN released audio in which Trump appears to be sharing the contents of an allegedly classified document regarding Iran.
The former president is facing a 37-count federal indictment on allegations that he mishandled classified documents that he took to his Mar-a-Lago resort/home when his term as president ended.
According to the federal indictment, one or more of the 37 charges against the former president involves content that is allegedly a “plan of attack on Country A,” revealed to be Iran via the audio recording. The indictment claims Trump unlawfully told this classified information to a writer, a publisher, and two of his own staffers, as none of them had the “need-to-know” clearances necessary to receive the information.
The recording, which CNN speculates will be part of the evidence that a jury in the Mar-a-Lago case will consider, was made in July 2021 at Trump’s club in Bedminster, New Jersey. Trump allegedly knew he was being recorded, CNN reported, though it is not clear who was doing the recording.

In the recording obtained by CNN, Trump is heard producing the subject documents ostensibly to prove to his audience that Gen. Mark Milley wanted to attack Iran while Trump did not. Milley was chief of staff of the Army when Trump assumed office and was promoted to chairman of the joint chiefs of staff by Trump in September 2019.
Trump can be heard shuffling through papers that he contends prove he is correct before noting, “Except it is like, highly confidential. … Secret. This is secret information.”
He then appears to be asking someone for confirmation regarding the documents.
“This was done by the military and given to me. Uh, I think we can probably, right?” Then Trump adds, “See, as president, I could have declassified it. Now, I can’t. You know, but this is still a secret.”
After CNN aired the audio clip, Trump took to the Truth Social platform to accuse Special Counsel Jack Smith, the Department of Justice, and the FBI of illegally leaking the audio to mislead the public.
“The Deranged Special Prosecutor, Jack Smith, working in conjunction with the DOJ & FBI, illegally leaked and ‘spun’ a tape and transcript of me which is actually an exoneration, rather than what they would have you believe. This continuing Witch Hunt is another ELECTION INTERFERENCE Scam. They are cheaters and thugs!” Trump posted.
Later, he added, “COULD SOMEBODY PLEASE EXPLAIN TO THE DERANGED, TRUMP HATING JACK SMITH, HIS FAMILY, AND HIS FRIENDS, THAT AS PRESIDENT OF THE UNITED STATES, I COME UNDER THE PRESIDENTIAL RECORDS ACT, AS AFFIRMED BY THE CLINTON SOCKS CASE, NOT BY THIS PSYCHOS’ FANTASY OF THE NEVER USED BEFORE ESPIONAGE ACT OF 1917. ‘SMITH’ SHOULD BE LOOKING AT CROOKED JOE BIDDEN [sic] AND ALL OF THE CRIMES THAT HE HAS PERPETRATED ON THE AMERICAN PUBLIC, INCLUDING THE MILLIONS & MILLIONS OF DOLLARS HE EXTORTED FROM FOREIGN COUNTRIES!”
A spokesperson for Trump told Newsweek, “The audio tape provides context proving, once again, that President Trump did nothing wrong at all. The President is speaking rhetorically and also quite humorously. … The media and the Trump-haters once again were all too willing to take the bait, falling for another Democrat-DOJ hoax, hook, line, and sinker.”
