Suspended Texas Attorney General Ken Paxton’s trial on securities fraud will not be moved to Collin County after all.

The Texas Court of Appeals ruled 6-3 on Wednesday to keep it in Houston, county seat of Harris County.

The venue has been a point of contention in the securities case against Paxton, who faces an impeachment trial this summer in the Texas Senate.

The case dates back to accusations that Paxton solicited investors in McKinney-based Servergy Inc. without disclosing he was being paid to promote the stock.

“We’re gratified but not surprised that the Court recognized that this defendant must stand trial before a Harris County jury and a judge who will follow the law,” prosecutor Brian Wice said in a statement.
